- communication problems as regards rail and bus connections.

Closing remarks

The legal fact of obtaining the health resort status by a commune is a stimulus to undertake some marketing action. The commune's name itself conveys important information. It indicates that it is a health resort, where one can find:

- medicinal resources, for instance curative waters and minerals (peloid),

- clean air,

- spa infrastructure, e.g. parks, graduation towers, promenades,

- high standard healthcare.

However, the health resort status does not protect a given area against dangers resulting from legal and economic factors such as e.g.:

- frequent lack of clearly determined tourist policy,

- slow liquidation of environmental pollution,

- insufficient funds for effective promotional policy.

Generally speaking, the establishment of these institutions is a management tool of activity of seniors in the commune's social life.

A COMMENTARY TO THE REGULATION OF ARTICLE 5C OF THE COMMUNE SELF-GOVERNMENT ACT ON THE ESTABLISHMENT OF THE COMMUNE BOARD OF SENIORS

Abstract

The commentary proves that communes implement broadly defined social policy at local level. It is shown the establishment of social institutions manifests the participation of seniors in the commune's social life. Keywords: self-government, communes, board of seniors

Article 5 c has been given an analysis:

- Par. 2 "Commune Council, on its own initiative or upon the request of interested parties, may establish the commune board of seniors"

- Pr. 3 "Commune board of seniors performs a consultative, advisory, and initiative function"

The aim of the legal interpretation of the above regulations is to determine the

legal status of the commune board of seniors. The regulation was added to Article 1 of the Act amending the Commune Self-government Act of 11 October

2013ZJ with the aim of better identification of elderly people's needs. The amendment's premises were developed by the Parliamentary Group for Universities of the Third Age and presented on 19 March 2012 at the 1st Congress of

Universities of the Third Age . The necessity of increasing elderly people's social activity was noticed also by the Council of Ministers which on 24 August 2012 adopted the Government Programme for the social activity of elderly people for the years 2012-2013. Simultaneously, the Senior's Policy Department was established in the Ministry of Labour and Social Policy.

The essential problem is to determine the legal status of the commune board of seniors. A linguistic interpretation of the above provisions allows one to draw the following conclusions: the commune board of seniors is not:

- a commune's organ - Article 11a Par. 1 of the Commune Self-government

Act of 8 March 1990 provides an exhaustive list of commune organs;

- a commune's organizational unit - Article 9 Par. 1 of the Commune Self-government Act26 - the commune establishes such units in order to perform public tasks - commune boards of seniors do not perform public tasks as the legislator has not authorised them to do so;

- an auxiliary unit - Article 5 and 35 - the boards are not established on the

basis of the auxiliary territorial division , they do not have an internal structure, and do not perform tasks devolved on them by communes;

- an auxiliary apparatus - Article 33 of the Commune Self-government Act -that function is reserved only for Commune Office which provides service for commune organs; it is a set of material resources and persons, which enables an

organ to perform its tasks and competences - the commune board of seniors does not possess such features;

- a specialized auxiliary organ - Article 18a, 19, and 21 of the Commune Self-government Act - pursuant to these provisions the board is not an internal organ - the establishment of the commune board of seniors depends on the commune council's will. Thus, the lack of such body does not influence the tasks performed by the commune.

As a result, the commune board of seniors should be regarded as a certain kind of social institution. Approached in this way, the board is:

- an organized and sustainable representation of a part of community, that is seniors living in the area of a given commune;

- an instance of formalized leadership - the board represents elderly people's interests in a given commune;

- an institution enabling to influence the commune council in a formal way - by e.g.: consultation, advising, initiating the commune's actions as regards elderly people issues;

- an institution interested in its fundamental aim, that is securing its own interests while the local policy is being implemented by the commune.

The fact that commune boards of seniors do function proves that communes implement broadly defined social policy at local level. The boards contribute to the development of self-government, the development of cultural legacy of a given community, and the activation of elderly people. Above all, however, the establishment of those institutions manifests the participation of seniors in the commune's social life.

The present Review is devoted to the analysis of important social document -the regulation added by the Act amending the Commune Self-government Act of 11 October 2013 (Journal of Laws 2013, item 1318); the Act became effective on 30 November 2013.

This Law affects the interests: the regulation is intended for the representatives of elderly people and the representatives of entities that act for the benefit
